Terms of Use

The rules that govern Auctaro™ auctions, seller access, bidding, checkout, shipping, reports, user disputes, and collectible authenticity responsibilities.

Introduction

These Terms of Use govern access to and use of Auctaro™, a specialized online auction marketplace for Pokemon cards and other trading card game collectibles.

By accessing or using the platform, you agree to these Terms. If you do not agree, you must not use the platform.

The platform may only be used by persons who are at least 18 years old.

Definitions

  • Auctaro™ means the platform, website, and related services provided by Auctaro™.
  • Platform means the website and digital environment through which Auctaro™ services are provided.
  • User means any person who visits or uses the platform.
  • Buyer means a user who bids on or purchases an item through the platform.
  • Seller means an approved user who creates auctions and offers items for sale.
  • Auction means the online bidding process for a specific item.
  • Item means a trading card, sealed product, lot, accessory, or other related collectible offered in an auction.
  • Final price means the highest valid bid at the close of an auction.
  • Payment provider means the independent provider used to process payments and seller payment onboarding.
  • Shipping provider means any independent person or company used for shipment or delivery.
  • Report means a notice submitted to Auctaro™ concerning suspected fraud, counterfeit items, misleading descriptions, non-delivery, abuse, or other violations.

Auctaro™'s role

Auctaro™ operates solely as an intermediary online auction venue. Auctaro™ is not the seller, buyer, auctioneer, agent, broker, authenticator, appraiser, carrier, or guarantor of any user.

Auctaro™ does not take ownership of listed items, does not transfer ownership from seller to buyer, and does not guarantee authenticity, origin, condition, grading, certification, rarity, completeness, legality, fitness for purpose, or market value.

The sale contract is formed solely between the buyer and the seller. Users acknowledge that Auctaro™ is not responsible for buyer or seller performance except where mandatory law provides otherwise.

  • Auctaro™ may provide technical tools for listings, bidding, checkout, messaging, reports, moderation, and payment facilitation.
  • Auctaro™ may review reports and take platform actions, but such review does not make Auctaro™ a party to the transaction.
  • Auctaro™ may remove content or restrict accounts to protect the marketplace, without accepting liability for the underlying user conduct.

Accounts and access

An account is required to bid, buy, create listings, or use protected marketplace features.

  • Users must provide true, accurate, complete, and current information.
  • Users must keep account credentials secure and are responsible for activity under their account.
  • Users must promptly notify Auctaro™ of unauthorized use or suspected compromise.
  • Users must not create false, misleading, duplicate, or abusive accounts.
  • Auctaro™ may refuse, suspend, restrict, or terminate accounts at its reasonable discretion.

Seller approval

Selling is not automatically available to all users. Seller access is a trust and safety control for the marketplace, not an Auctaro™ warranty to buyers.

  • A seller must have a verified account.
  • A seller must be manually approved by Auctaro™ before listing.
  • A seller must complete payment onboarding before auctions are enabled.
  • A seller must not be suspended or otherwise restricted.
  • Seller approval does not guarantee the authenticity, quality, reliability, or future conduct of that seller or any item listed by that seller.

Auction rules

By creating an auction, the seller represents and warrants that the seller has the legal right to sell the item and that the listing is accurate, lawful, and not misleading.

  • The item must be free from third-party claims, liens, theft allegations, and sale restrictions.
  • Photos must show the actual item offered, unless the listing clearly and lawfully states otherwise.
  • The title, description, condition, language, edition, set, rarity, grading, certification, defects, alterations, and authenticity information must be accurate.
  • The seller must not conceal material defects, restoration, trimming, recoloring, resealing, proxy status, replica status, or other information that would reasonably affect a buyer's decision.
  • The seller must not list counterfeit, altered, stolen, illegal, or infringing items.
  • The seller must not bid on the seller's own auction or arrange bidding by related persons, family members, employees, collaborators, secondary accounts, or other connected persons to manipulate price or demand.
  • Where shill bidding, collusion, or connected-account bidding is suspected, Auctaro™ may unilaterally cancel the auction, cancel bids, restrict or permanently ban the seller and related accounts, block associated payment instruments, devices, network identifiers, and contact details, and take any further marketplace action reasonably required to protect users.
  • Users must not encourage or complete transactions outside the platform to avoid fees, moderation, or buyer and seller protections.
  • Off-platform transaction attempts may result in immediate and permanent account termination, loss of seller privileges, cancellation of affected transactions, and Auctaro™ may claim or charge an amount equivalent to the marketplace fees that would have applied to the avoided transaction, to the extent permitted by law.

Bids and binding effect

Each bid submitted through the platform is binding. If a buyer is the highest bidder when the auction closes, the buyer is expected to complete payment before the payment deadline shown in the order flow.

Auctaro™ may use anti-sniping extensions. Late bids may extend the auction closing time so that other bidders have a fair opportunity to respond.

  • Bids may not be withdrawn arbitrarily.
  • Failure to pay may result in warnings, account restrictions, suspension, cancellation of transaction privileges, or other marketplace action.
  • If the winning buyer does not pay on time, Auctaro™ may provide the seller with available options, including offering the item to another eligible bidder or ending the order chain.

Payments and fees

Payments are processed through an independent payment provider. Auctaro™ does not provide banking, electronic money, escrow, card processing, or other regulated financial services unless expressly stated in writing and authorized by law.

Auctaro™ may facilitate checkout, calculate applicable marketplace fees, and control seller release timing through the available payment provider tools.

Sellers acknowledge that funds from an auction may be held by the payment provider or otherwise delayed until delivery is confirmed by tracking, the buyer confirms receipt, the applicable dispute window expires without a valid dispute, or Auctaro™ otherwise determines that release is appropriate under the marketplace rules.

  • The buyer may be charged the final item price, shipping costs, buyer service fees, taxes, and other applicable charges shown during checkout.
  • The seller may be charged seller fees, payment-related deductions, or other platform fees disclosed in the listing or payment flow.
  • Fees may vary by item value, category, country, payment method, shipping method, or marketplace policy.
  • Auctaro™ may change fees for future transactions. Historical orders are governed by the fee amounts applied at the time of the relevant transaction.

Shipping and delivery

Shipping and delivery are the seller's responsibility. The seller must ship the item promptly, securely, and according to the delivery details provided through the platform.

Where a BOX NOW locker or other pickup location is offered, Auctaro™ acts only as a technical destination-selection tool. Auctaro™ does not necessarily issue shipping labels, does not perform carriage, and is not responsible for acts or omissions of shipping providers.

  • The seller is responsible for suitable packaging for collectible cards and sealed products.
  • The seller must provide accurate shipment information where requested.
  • Risk allocation between buyer and seller may depend on applicable law, platform rules, payment provider rules, and the facts of the case.
  • Auctaro™ may request shipment proof, delivery confirmation, photos, videos, or other evidence during dispute review.

Authenticity and collectible condition

Auctaro™ is a specialized collectibles marketplace, but it does not physically authenticate every item. Marketplace moderation, seller approval, listing standards, reporting tools, or buyer protection messaging do not create an Auctaro™ guarantee of authenticity or condition.

The seller is solely responsible for ensuring that the delivered item matches the listing and that all authenticity, condition, grading, and certification statements are accurate.

  • For graded cards, the seller is responsible for accurately identifying the grading company, grade, certification number, holder condition, and any known concerns.
  • For ungraded cards, the seller is responsible for accurately describing visible wear, surface issues, dents, whitening, creases, print lines, centering, alterations, or other relevant condition matters.
  • For sealed products, the seller is responsible for disclosing resealing concerns, tears, dents, tampering, missing contents, language, region, and edition details.
  • Buyers must carefully review photos, descriptions, grades, certifications, seller information, pricing, and risk before bidding.
  • Auctaro™ does not provide investment, valuation, grading, authentication, tax, customs, or collecting advice.

Reports, fraud, and counterfeit items

Users must promptly report suspected fraud, counterfeit items, altered items, misleading listings, non-delivery, payment abuse, bid manipulation, harassment, threats, or other violations through the available platform reporting channels or by contacting Auctaro™ support.

Reports should be specific, timely, and supported by evidence. False, malicious, or abusive reports may themselves result in account action.

  • Auctaro™ may request photos, videos, unpacking evidence, shipment receipts, tracking information, payment records, grading records, certification lookups, expert opinions, and communications between users.
  • Auctaro™ may remove or hide listings, restrict bidding, restrict selling, suspend accounts, delay seller release, cancel transactions where permitted, request return of an item, or disclose information to competent authorities where required by law.
  • Auctaro™ may prioritize reports involving suspected counterfeit goods, fraud, user safety, payment risk, or repeated marketplace abuse.
  • Auctaro™ does not guarantee that every report will result in removal, refund, cancellation, compensation, or a decision in favor of the reporting user.

User disputes

Auctaro™ provides a reporting and administrative review mechanism for marketplace disputes, but Auctaro™ does not become a party to the transaction and does not act as a court, arbitrator, insurer, authenticator, or legal representative of any user.

Users must cooperate honestly and promptly during dispute review. Failure to provide requested information may affect the outcome of a review.

  • Disputes may include non-delivery, item not as described, suspected counterfeit items, damaged shipments, payment issues, abusive conduct, or other transaction problems.
  • Unless mandatory law requires a longer period, buyers must submit an item-related dispute within three calendar days after the item is marked as delivered or otherwise confirmed as available for pickup. Late reports may be declined if delay prevents fair review.
  • Where return of an item is required during a dispute, the item must be returned using tracked shipping and adequate protective packaging. Unless Auctaro™ determines that the seller materially breached the listing, authenticity, or shipping obligations, the buyer is responsible for return shipping costs. If the seller is found at fault, Auctaro™ may require the seller to bear or reimburse reasonable tracked return shipping costs.
  • Auctaro™ may temporarily delay seller release while reviewing a dispute or suspected violation.
  • Auctaro™ may make platform decisions based on the information reasonably available at the time.
  • Auctaro™ may reverse, adjust, or decline a marketplace action if new information becomes available.
  • Users remain responsible for any legal claims they may have against each other. Auctaro™'s dispute review does not waive or replace rights available under applicable law.

Prohibited conduct

  • Violating laws, regulations, third-party rights, or these Terms.
  • Posting false, incomplete, or misleading content.
  • Selling counterfeit, stolen, unlawful, infringing, unsafe, or restricted items.
  • Manipulating auctions, shill bidding, bid shielding, collusion, or artificially inflating prices.
  • Harassing, threatening, impersonating, or abusing other users or Auctaro™ staff.
  • Circumventing fees, checkout, reporting flows, account restrictions, or security measures.
  • Using unauthorized automated tools, scraping, crawling, load testing, or reverse engineering.
  • Uploading malware, interfering with platform operation, or exploiting technical errors.

Auctaro™'s rights

Auctaro™ may take action to protect users, comply with law, manage risk, and preserve marketplace integrity.

  • Auctaro™ may edit, reject, remove, demote, or hide listings or content.
  • Auctaro™ may suspend, restrict, or terminate accounts or specific marketplace features.
  • Auctaro™ may require additional identity, seller, payment, shipment, authenticity, or transaction information.
  • Auctaro™ may delay payment-related functions where there is reasonable suspicion of fraud, counterfeit items, non-delivery, chargeback risk, legal risk, or Terms violations.
  • Auctaro™ may cooperate with payment providers, shipping providers, intellectual property owners, law enforcement, regulators, and courts where appropriate or required.

User content

Users retain ownership of content they upload, but grant Auctaro™ a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, translate, distribute, and promote that content for platform operation, marketing, trust and safety, dispute review, and legal compliance.

Users warrant that they have all necessary rights to photos, descriptions, names, logos, and other uploaded materials.

Intellectual property

The platform, trademarks, branding, design, software, text, graphics, interfaces, and other Auctaro™ materials are protected by intellectual property rights.

Nothing in these Terms grants users any right to use Auctaro™ trademarks, branding, code, designs, or materials without prior written permission.

Personal data

Personal data is processed under Auctaro™'s Privacy Policy. By using the platform, users acknowledge that their data may be shared with payment providers, shipping providers, technical providers, professional advisers, and competent authorities where required to provide services, prevent fraud, resolve disputes, or comply with law.

Limitation of liability

To the maximum extent permitted by law, Auctaro™ is not liable for user conduct, user content, auction outcomes, the authenticity or condition of items, buyer or seller performance, shipment loss or damage, payment provider acts or omissions, shipping provider acts or omissions, or disputes between users.

Auctaro™ is not liable for indirect, incidental, special, consequential, punitive, exemplary, loss-of-profit, loss-of-opportunity, loss-of-data, reputational, business interruption, or market-value losses, whether arising in contract, tort, negligence, statutory duty, or otherwise.

Nothing in these Terms limits liability that cannot be limited under mandatory law.

Indemnity

Users agree to indemnify and hold harmless Auctaro™, its directors, officers, employees, contractors, advisers, affiliates, and representatives from claims, losses, liabilities, damages, fines, penalties, costs, and expenses arising from user content, user transactions, breach of these Terms, unlawful conduct, counterfeit or misleading items, infringement of third-party rights, or disputes with other users.

Changes to these Terms

Auctaro™ may amend these Terms from time to time. Changes apply from publication unless stated otherwise. Continued use of the platform after changes means acceptance of the updated Terms.

Governing law and dispute resolution

These Terms are governed by the laws of the Republic of Cyprus, unless mandatory consumer protection law provides otherwise.

Users should first attempt in good faith to resolve concerns by contacting Auctaro™. If a dispute is not resolved, the courts of the Republic of Cyprus shall have jurisdiction, unless mandatory law provides otherwise.

Severability

If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision shall be limited or removed only to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire agreement

These Terms, together with any policies or rules expressly incorporated by reference, constitute the entire agreement between the user and Auctaro™ regarding use of the platform and supersede prior understandings relating to that subject matter.
